Legal Experts Warn Stay Orders on Gachagua’s Impeachment Cannot Be Vacated Until Full Case Is Heard

As the court battles surrounding the impeachment of Deputy President Rigathi Gachagua continue, legal experts and observers are raising several constitutional and legal questions about the unfolding situation. Chief among them is whether a court bench can override previously issued conservatory orders if the merits of the case have not yet been fully considered.

This issue is central to the ongoing legal disputes, where conservatory orders were issued to halt certain actions pending the full hearing of the impeachment case. The ability of a new bench to override these orders before the case is fully examined could set a critical precedent.

Further complicating matters is the question of whether Prof. Kithure Kindiki’s swearing-in as Deputy President could be valid if the courts have not yet settled the legality of Gachagua’s impeachment.

Constitutional experts warn that allowing Kindiki to assume office before a final ruling on the impeachment case could create legal and political chaos. Should Gachagua be reinstated after Kindiki has taken office, there would be significant constitutional implications, particularly concerning the validity of both officials’ roles and the stability of the executive branch.

Additionally, the prospect of an out-of-court settlement between Gachagua and the government raises further concerns.

In cases involving public office, such settlements must adhere to strict legal standards, especially when the electorate’s representation is at stake.

The implications of such a settlement on Gachagua’s right to hold office, as well as the overall integrity of the Senate’s impeachment process, would need to be thoroughly examined to ensure that the constitutional rights of both the public and the individuals involved are upheld.

These legal questions reflect the complexity of the case, with far-reaching consequences for Kenya’s governance and rule of law.
