Kenya has been sued at the International Court of Arbitration by three Italian firms over the failed construction of the controversial Arror and Kimwarer dams.

Cooperativa Muratori & Cementisti -CMC Di Ravenna Societa Cooperativa (Italy), Itinera S.P.A and CMC Di Ravanna- Itinera JV S.C.P.A., according to court documents, have filed a case against the Kerio Valley Development Authority (KVDA).

Filed last year on December 15th, the three companies are demanding $114.1million from the Kenyan government, plus costs of the case and expenses to be incurred by its lawyers during the case hearing. Also among its demands, is for Kenya to reverse its decision for cancelling the contracts of construction of the two dams.

”Accordingly, order KVDA to pay the claimants all the amounts provisionally indicated as US$114,177,645, or any other different sum that will result due to claimants in the course of the proceedings, plus interest as applicable,” a part of the court papers read.

State House, through the Solicitor General, has written to Elgeyo Marakwet Governor Alex Tolgos asking for documentations of the project.
